As right to development is not legally enforceable yet (except for states-parties to African Charter on Human and Peoples’ Rights), states` duty to cooperate in development derives from UN Charter, International Covenant on Economic, Social and Cultural Rights, Convention on the Rights of the Child, Convention on the Rights of Persons with Disabilities and international customary law. This monograph provides an analysis of the provisions of these international legal instruments in respect to duty of international cooperation in development. It would be especially useful to international lawyers, development scholars and practitioners.

Intercultural Dynamics and Development

This study addresses the relationships on international cooperation for development that put cultures into motion. This is a socio-anthropological research that outlines the cognitive orientation of both sides in the international cooperation: who provides and who receives Aid. The locus of the investigation is an international cooperation project in Mozambique, along with interviews with Italian NGOs practitioners. The thesis argues that international cooperation not only provides projects aiming to change the situation in developing countries, but unites cultures that mutually exchange meanings, disagreements, habits, etc., in a continuous process of cultural ‘miscegenation’. Although most NGOs propose bottom-up approach to development, usually projects start from the top, and face difficulties to stimulate the ‘agency’ to change from below. In a macro perspective, globalization continues to play a dominant role in the poorest countries, and Mozambique is still dependent on foreign aid.

In the time of dynamic changes in higher education led by globalization and internationalization, the study broadly examines the origins of international joint degree programs, with a focus on developments in Europe. International joint degree programs are often portrayed in the literature as one of the most advanced forms of international cooperation and internationalization efforts that are key to the future development of an institution. The thesis first presents a historical overview and analysis of some of the key elements of the recent debate about internationalization process in higher education, in particular about international university cooperation in Europe. Second, the thesis examines the origins of several joint degree schemes at a university in Hungary, an institution that has been particularly successful in establishing this form of international cooperation. The findings from this particular Hungarian university seem to contradict the presumed strategy-led path to joint degree programs, and suggest that institutional decentralization and more of an ad-hoc or bottom-up approach could also lead to development of international joint degree programs.

Carrots, Sticks and International Cooperation

The connection between diamonds and bloody civil conflicts in a number of African countries has made the headlines of newspapers all since the end of the 1990s. To resolve this disturbing issue, the international community has come up with the Kimberley Process Certification Scheme (KPCS). This work fundamentally investigates the conditions that made the KPCS possible in the first place. Drawing from the international relations literature on conflict and cooperation, we propose that international cooperation in the case of conflict diamonds was facilitated by five main conditions, regarding the inclusivity of the negotiation process, the presence of a transnational action network, the credibility of threats and commitments, and the self-enforcing nature of the scheme itself. Subsequently, we apply our analysis to the case of the current negotiation process for an Arms Trade Treaty (ATT), thereby confirming our findings that international cooperation leads to optimal results only when all concerned actors are involved, information is adequately shared, credible commitments and threats are made and, most importantly, there is enough willingness to act together.

This thesis argues that a human rights-based approach to development cooperation (HRBA-DC) can contribute to the implementation of the international dimension of the right to development.
